OK Wikipedia defines: "Deferred Action for Childhood Arrivals (DACA) is an American immigration policy founded by the Obama administration in June 2012. DACA allows certain illegal immigrants who entered the country as minors, to receive a renewable two-year period of deferred action from deportation and eligibility for a work permit."
That is a Conditional Pardon -- every two years they need to file ... file what? their desire to retain the PARDON.
@POTUS44 PARDONED Dreamers and now Congress needs to determine their resident status -- do they stay conditionally pardoned, or are they given full legislative pardons?
The legislature could define them [DACA] as Nationals without Citizenship status; or, as individual now entitled to file for Citizenship; or, as foreign-born residents who must continue to file every two years, or maybe some longer term.
@POTUS45 DACA was a @POTUS44 PARDON -- even though he did not specifically state it as such. The President has no authority to legislate immigration, but by deferring action based on regular filing, Obama effectively and legally PARDONED children who were brought here by their parents.
It can be argued DACA was an executive management action -- but that raises a question of authority to distort immigration law by selective enforcement. Selective Enforcement seems like it would be an illegal act... So it falls on TRUMP and Congress to declare it such and then obtain SCOTUS verification of the illegality.
